Terms of purchase

    The website www.damogu.org is owned by the company Da-Mogu d.o.o., with its registered office in Zagreb, Marko Marulić Square 12, OIB: 56216842434 (hereinafter Da-Mogu d.o.o.). Da-Mogu d.o.o. allows the use of the services and content of the website www.damogu.org which is regulated by these Terms of Purchase.
    In terms of these terms of purchase, the customer is a natural or legal person who orders at least one product or service, fills in the required information, and pays for the ordered product through the website www.damogu.org.
    If data on a legal person are entered in the customer data, then the customer is considered a legal person, and the natural person whose data are entered is considered an authorized person of the customer.
    For a valid order of products and/or services, the person filling out the order must be over 18 years of age (legal capacity), otherwise, he has unauthorized access to the site www.damogu.org. The customer is responsible for the accuracy and completeness of the data entered during registration and/or purchase. Da-Mogu d.o.o. reserves the right to change these terms of purchase and may change them without prior notice, but undertakes to notify all registered users by e-mail addresses that they entered during registration. All possible changes will be applied to the use of the  www.damogu.org website.
    Da-Mogu d.o.o. undertakes to clearly, visibly, and legibly display the amount of the retail price following Article 7 of the Consumer Protection Act (OG 41/14). Da-Mogu d.o.o. will periodically, in accordance with its decision, put certain products on sale at a price lower than the price of these products in regular sales or under special conditions that will be clearly indicated on this website, and also undertakes to clearly and legibly mark and indicate the duration of the special sale and special offer. After the expiration of the term of the sale or special offer, no orders will be accepted under the conditions relating to the expired sale.
    Product photos are illustrative and do not always correspond in all details to the products that are the subject of the order. Da-Mogu d.o.o. especially emphasizes that the visual identity of the product shown in the photo does not have to match the appearance of the product in reality, especially given the monitor settings on the customer’s computer, differences in color perception as the customer sees them on the screen,etc. In the case of the above discrepancy between the product shown in the photo and the delivered product – this is not a shortage of products. Product data (product description, price, etc.) displayed on the site www.damogu.org are subject to errors in the display (bugs), irregularities in the operation of the application, other technical irregularities, typographical errors, etc. In the event of obvious errors or inaccuracies in the product information displayed at www.damogu.org, Da-Mogu d.o.o. reserves the right to unilaterally terminate the contract. The subject of the order can only be products for which the order states that they are available for the order. If the ordered product is not available, Da-Mogu d.o.o. will inform the customer that the product is not currently available, about the period in which the product is available, and also offer the possibility of buying an alternative product from the www.damogu.org range that is available for delivery and which is closest to the product that can not be delivered or offered a refund in full.
    Products are ordered by selecting, using the menus, and filling out a very simple electronic form on our websites The customer can order and purchase the product as a registered or unregistered user. The product is considered ordered when the customer goes through the entire ordering process.
    The customer can pay for the ordered products through our site in the following ways:

    • Single-use credit cards
    • Cryptocurrencies
    • KeksPay
    • Transactional issuance of bids/ proforma invoices
    • Cash on delivery

    The order is considered received:

    • In the case of payment by credit card, cryptocurrencies and via KeksPay – at the time when www.damogu.org receives confirmation of pre-authorization of the customer’s credit card on the amount of the order or confirmation of the successful transaction (cryptocurrencies, KeksPay)
    • In case of payment by transaction by issuing bids/ proforma invoices and cash on delivery – at the moment when www.damogu.org receives the order electronically.

    If the customer does not receive the notification from the previous paragraph, it is suggested to check:

    • Is the message in the Junk/Spam folder
    • Is the mailbox full
    • Are the items in the cart after logging in to www.damogu.org and, if not, the customer should repeat the ordering process

    In the case of payment by credit card, the contract is considered concluded at the time when Da-Mogu d.o.o. receives a confirmation of pre-authorization of the customer’s card on the amount of the order and when Da-Mogu d.o.o. during preparing the order, confirms that the ordered product is available.
    After the product is packaged in the warehouse, Da-Mogu d.o.o. will notify the customer electronically in the form of an e-mail that he has purchased the product and that the product has been sent, or this will be done by an authorized courier service.
    In the case of payment by e-banking and through the bids / proforma invoice, the contract is considered concluded at the time when Da-Mogu d.o.o. receives confirmation that the order amount has been paid.
    If the product is ordered, and e-banking is chosen as the method of payment or by the bids / proforma invoice, Da-Mogu d.o.o. undertakes to reserve the product in the warehouse for 3 working days, not including Saturday. After the expiration of 3 working days from the receipt of the order, Da-Mogu d.o.o. does not guarantee product availability.

    By selecting each product next to it, the details are printed – product name, description, price, and whether it is available for order. By selecting an individual product, it is included in the “Cart” menu. The prices displayed on the pages next to each product are valid for all forms of payment and are expressed with VAT. By accessing the “Cart” menu, the customer gets an insight into the selected products, their quantity, and price. Below, the customer accesses the order form in which he is obliged to enter personal data. If the customer’s personal data differs from the recipient’s personal data, he is obliged to indicate the recipient’s data by selecting the specified option. When ordering, for all customers at www.damogu.org, the cost of delivery of packages for orders within the Republic of Croatia is free and will not be charged later. You can check other delivery prices in the table on the PAYMENT AND DELIVERY link. After receiving the data from the order, a notification will be displayed on the screen that the customer’s order has been received, and the customer will receive special notification about the receipt of the order electronically to the specified e-mail address. If payment by e-banking or by bids / proforma invoice has been chosen as the form of payment, and www.damogu.org does not have the ordered product at its disposal due to the lack of goods in the warehouse, Da-Mogu d.o.o. will, within a reasonable time inform the customer that the product is currently not available, about the period in which the product is available and also offer the possibility of buying an alternative product from www.damogu.org range that is available for delivery and which is closest to the product that can not be delivered or offer refund money in full. In the case of the above payment and the selected refund, the customer is responsible and bears the risk for the accuracy and truthfulness of the submitted data, given that www.damogu.org will refund following the submitted data.
    All prices are expressed in the national currency of the Republic of Croatia, Croatian kuna (kn), including VAT. In the case of payment by e-banking and general payment slip, the costs of payment and/or interbank transactions are not included in the price.
    We deliver goods to the entire territory of the Republic of Croatia, and for delivery outside the Republic of Croatia, check the table on the link PAYMENT AND DELIVERY. Delivery of ordered packages is performed by the delivery service, ie a third party on which Da-Mogu d.o.o. cannot affect. The cost of delivery of packages for orders within the Republic of Croatia is free for purchases over HRK 700 and will not be charged later. For purchases under 700 kn (92,90€), delivery is charged 39.00 kn (5,17€). You can find other delivery prices on the PAYMENT AND DELIVERY link.
    We undertake to deliver your order on time if you have filled in your information completely accurately and truthfully. All orders received on a working day by 1 pm are processed on the same day so that in most cases the ordered product is delivered to the delivery service on the same day. Orders after 1 pm on working days (except Fridays) are delivered the next day, while orders from Friday after 1 pm are submitted on Mondays. On Mondays, we also process orders received during Saturday and Sunday. Unfortunately, we are unable to influence the further speed of delivery and possible complications related to the delivery itself caused by the DHL delivery service. For each shipment, the recipient certifies and signs the delivery list upon receipt of the shipment. According to the provisions of the Civil Obligations Act, the certification of the delivery list by the recipient is considered that the shipment was delivered in undamaged condition and after that, the delivery service is released from any subsequent liability. If the recipient does not exist at the specified address or the address is unknown, the delivery service will try to contact the recipient to agree on the exact time and possibly another delivery address. If the product sent to the customer or recipient is returned to the warehouse Da-Mogu d.o.o. because the delivery service failed to make the delivery, the customer will be notified by e-mail and will be offered the following options:

    • At the request of the customer by e-mail, the ordered product is delivered again to the address of the customer or recipient
    • To pick up the ordered product at the address by agreement with the delivery service, with prior telephone agreement on the date of collection

    In case of impossibility of delivery, the shipment is returned to the warehouse www.damogu.org and each subsequent attempt to deliver to the customer will be charged in the amount of 30.00 kn (3,98€) – if the product is previously paid by credit card, transaction.

    If such an order was to be paid by cash on delivery, the buyer will be deemed to have given up the final purchase.

    To the islands covered by the delivery service, the product will be delivered according to a special schedule – of which you will be notified, and to all other islands not covered by our delivery service, we will send the products via HP.

    Da-Mogu d.o.o. is responsible for material defects in the products it sells on its website, following the legal regulations of the Republic of Croatia, and in particular the Law on Obligations. The ordered products are packaged in such a way that they are not damaged by the usual handling in transport/delivery. If the shipment is damaged in transport, such damage is visible when taking over the shipment, in which case we suggest that the shipment is not picked up by the buyer. We ask customers to contact us so that we can check the condition of the shipment as soon as possible and send a new one. In case of a visible lack of product when taking over the shipment, the buyer is not obliged to take over the delivered product, ie he can refuse to receive it. It is considered that the products duly received by the customer did not have a visible defect. Upon receipt of the goods, checking the correctness of the order depends on the customer, and the customer is obliged to compare the received items with the invoice, and if something is missing he must immediately notify the courier or company within one hour because Da-Mogu d.o.o. subsequent complaints will not be considered. By refusing to receive, the courier will return the shipment to Da-Mogu d.o.o., noting that the shipment contains a defect. If the product has a hidden defect (the defect that could not be detected by the usual inspection when taking over the goods), which the customer determines after opening the product – the customer has the right to terminate the contract and refund, replace the product, eliminate the defect or the reduced price.
    By a special regulation of the European Union, from 15.02.2016, throughout the EU, disputes related to online purchases will be possible to resolve through the ODR platform. The Dispute Resolution Platform is available at http://ec.europa.eu/consumers/odr/. This means that if you encounter a problem during an online purchase within the EU or disputes related to online ordering, first try to resolve it without involving the courts. This link can be used by consumers for cross-border consumer disputes. For consumer disputes in relation to traders from the Republic of Croatia, this possibility does not exist until the procedure is supported by the necessary legislation by the authorized bodies of the Republic of Croatia.
    The customer has the right to a refund of the product and a refund of the funds paid within 14 days without giving a reason. The customer must ensure: – that the product packaging is undamaged – that all parts of the product are undamaged due to possible improper handling – that none of the contents of the product packaging is missing. The return period of 14 days to a person designated by the customer, who is not a carrier, the goods which constitute the subject of the contract delivered into possession. The refund will be made in the same way as the payment was made within 30 days of receipt of the refund. If the customer agrees to another way to refund the amount paid, he does not bear any costs of refund. The amount to be refunded will be exceptionally reduced by the possible costs of the card operators if the product was initially charged by selecting a card payment. The customer is obliged to deliver or send the product (to the address where it will be sent) without undue delay, and in any case no later than 14 days from the day when the customer sent his decision to return the product. The direct costs of returning the product are borne by the customer. The customer is responsible for any impairment of the product resulting from the handling of the product, other than that which was necessary to determine the nature, characteristics and functionality of the product.     In case of a complaint, damage during delivery, error in data transfer, or any other defect, please contact us within 24 hours of receiving the order. The buyer is obliged to send a complaint by e-mail to info@damogu.org or in writing within the legal deadline of 14 days to the address: Da-Mogu d.o.o., based in Zagreb, Marko Marulić Square 12. Upon receipt of the consumer’s complaint, we will confirm the receipt in writing and will give a response, in writing, within a maximum of 15 days.The user acquires the right to complaints if:

    • the product is not delivered according to the instructions in the order
    • the delivered product does not meet the standards
    • The product has been damaged during delivery

    Upon receipt of the product, checking the correctness of the order depends on the customer, and the customer is obliged to compare the received items with the invoice, if something is missing, it is necessary to immediately note because subsequent complaints will not be considered.

    All the above complaints will be resolved in agreement with the customer or recipient of the product as soon as possible.

    In case of return of the product, the seller returns the amount in the official currency of payment, which may differ from the currency in which the buyer paid for the product (for example, in case of payment in cryptocurrencies, returns nominal prices in HRK).

Da-Mogu d.o.o. is not liable for any damage caused by the use of this website and the use of information from this website for purposes beyond their intended purpose.
    By accepting these terms of purchase, the customer agrees to the terms of these terms and accepts that they form an integral part of the contract for the purchase of products from the site www.damogu.org.
